| 被害人陈述是我国现行刑事诉讼法规定的法定证据之一，是大多数刑事案件的启动器,对于司法机关侦查与惩罚犯罪活动具有重要的指导意义。然而被害人陈述真伪并存，必须严格审查。我国目前对于被害人陈述的审查与审查其他证据相比不够严格与全面，容易使被害人陈述被轻信，导致错案。运用证伪思维这一科学的思维方法对被害人陈述进行审查，可以更好地全面认清被害人陈述，并对促进我国被害人陈述制度的发展有益。 |

| The victim statement is one of our country present Law of Criminal Procedure stipulation legal evidences, is the majority criminal case starter. It has the important guiding sense regarding the Judicial organ detection and the penalty criminal activity, moreover is also promotes our country legislative work and the evidence study development important link to its research, therefore consummates the examination which the victim stated to meet our country government by law construction basic requirement. However our country present regarding the examination which stated regarding the victim with other evidence compares is not very actually strict and comprehensive, often even more readily believed that the victim stated. Using attests to falsity of thought this science the thought method to state to the victim carries on the examination, may cause us better to clearly recognize the victim to state comprehensively, and to promotes our country victims to state system’s development has the help. |
