| 夫妻侵权责任要求以夫妻侵权行为存在为前提，主观要求是过错中的故意，而非过失，侵害后果由婚姻一方向另一方承担民事责任。在借鉴域外国家成熟的夫妻侵权责任制度的法律规定后，结合我国国情，从法理基础、物质基础、社会基础三个方面论述构造我国夫妻侵权责任制度的现实性和必要性以完善法律体系。 |
| 英文摘要: |
| The marital tort liability presupposes the existence of infringements, the subjective requirements being intentional fault, rather than negligence. The civil liability consequences is undertaken by one party of the marriage to the other. Drawing on mature couples tort liability systems in extra regional countries, this paper states the reality and necessity to improve our marital tort liability from three aspects which are the legal foundation, material foundation and social foundation. |
