| 甘肃东乡族刑事习惯法随着当代国家刑事立法的发展而不断发生着特征变迁。在国家刑事立法的萌芽期，东乡族刑事习惯法基本是保守的，极力排斥国家刑事法（政策）；在国家刑事立法的起步期，东乡族刑事习惯法对于国家刑事法开始有所借鉴；在国家刑事立法的发展期，东乡族刑事习惯法对于国家刑事法内容的吸收达到了前所未有的程度。东乡族刑事习惯法在国家刑事立法的三个进程中实现了自“封闭与保守”渐至“契合与兼容”再至“开放与转型”的特征变迁。普法运动、经济、教育的发展、文化的不断融合是促使其发生特征变迁的主要原因。当代国家刑事立法中应 |

| The feature of Gansu Dongxiang Criminal customary law has been changing all the time. At the stage of germination of national criminal legislation, The Gansu Dongxiang criminal customary law was not only very conservative but also excluded the national criminal policies. At the stage of starting of national criminal legislation, The Gansu Dongxiang criminal customary law was going to absorb the principles of national criminal law. At the stage of developing of national criminal legislation, the Gansu Dongxiang criminal customary law was almost overlaid by national criminal law. During the stages of national criminal legislation, the Dongxiang Criminal customary law has experienced conservatism,compatibility and transformation. The movement of popularizing laws, the development of economy and education and the fusion of cultures have been the reasons which made the Dongxiang criminal customary law change. The modern national criminal legislations should pay more attention to the criminal customary Laws of minority nationalities. |
